Good news for New York City restaurants: roadway dining no longer has to end with the season. Year-round roadway café approvals are underway, and SWA Architecture has begun securing them for restaurant clients.
For owners, it’s an opportunity to make outdoor seating a more lasting part of the business. For diners, it means more chances to enjoy a meal outside. New Yorkers can decide for themselves when it’s officially too cold for brunch.
A New Chapter for Outdoor Dining
New York City’s updated law allows approved roadway cafés to operate throughout the year under the Dining Out NYC program. Sponsored by Council Member Lincoln Restler and enacted in August 2026, the legislation puts NYC DOT in charge of implementing the expanded program. City legislation
Restaurants still need the appropriate authorization. Winter coverings and other modifications must meet applicable requirements, with accessibility, fire safety, sanitation, and snow removal remaining part of the planning process.
Helping Shape New York’s Café Culture Since the Early 2000s
SWA’s outdoor dining roots run deep. As early as 2002, The New York Times covered founder Steve Wygoda’s advocacy for restaurant owners seeking changes to the city’s sidewalk café restrictions. He had asked the mayor to reconsider policies that limited where restaurants could offer outdoor seating. The New York Times, June 2002
Steve helped shape the city’s small sidewalk café regulations through his participation in a city task force. By 2007, The Times reported that he had worked on more than 250 cafés in the preceding two years. His work helped restaurant owners navigate the intersection of hospitality, public space, and city approvals. The New York Times, November 2007
Today, SWA carries that experience into the next chapter of New York’s outdoor dining story.
Roadway Café Design, Permitting & Approvals
SWA Architecture provides sidewalk café and roadway café design, expediting, and outdoor dining permitting services across all five boroughs of New York City.
We help restaurant owners evaluate their outdoor space, prepare architectural plans, apply for year-round roadway café authorization, and coordinate with NYC DOT and other relevant agencies. As requirements evolve, we help clients understand what applies to their location and what comes next.
Whether it’s a first outdoor dining application or a transition to year-round operation, we bring decades of experience to the table. Literally, in this case.
