NYC’s New Sidewalk Shed Rules - Now in Effect!
Most sidewalk sheds, the scaffolding structures you see wrapped around buildings all over the city, do their job and disappear. A repair gets scoped, the work gets done, the scaffolding comes down within a season or two.
But every New Yorker can point to one on their block that's been up for years, past the point where anyone remembers why. As of this month, the city stopped letting those sit quietly.
New DOB rules under Local Laws 48 and 51 took effect August 13, and starting August 17, a sidewalk shed permit isn't something you just renew and forget. Owners now have to prove, every quarter, that the repair behind the shed is actually moving.
Permits for that scaffolding used to run indefinitely as long as you paid the renewal fee.
Now they expire every 90 days, no automatic renewal, and a registered design professional has to inspect the building and file a progress report each time: what's been fixed, what's underway, what's left, and if nothing's moved, why.
That report adds a $90 fee on top of the standard $130 renewal, $220 total each quarter.
Skip the progress, and the city gets serious. Starting with the second renewal, a shed with no active work behind it can draw a penalty based on how long it's been up: $10 per linear foot per month if it's under three years old, $100 per linear foot per month between three and four years, and $200 per linear foot per month after that, up to $6,000 a month.
DOB can hold your renewal until those penalties are paid off.
If the shed is there because of an unsafe façade, Local Law 51 puts its own clock on the wall: construction documents filed within five months, a permit application actively pursued within eight, and the repair completed within two years, or a penalty of $5,000 to $20,000 for each deadline missed.
New construction, demolition, enlargements, and one- or two-family homes are carved out of these rules, but for most commercial and multifamily buildings, this is the new normal.
